Terms of Service

Note: these terms were drafted to cover standard SaaS terms and TikTok's app review expectations. They have not been reviewed by a lawyer — worth a proper review before you scale to significant transaction volume or serve users in additional jurisdictions.

1. Agreement

By using TikPlan, you agree to these terms. If you're using TikPlan on behalf of an organization, you're agreeing on its behalf and confirming you have the authority to do so. TikPlan is operated by Puncak Digital Marketing.

2. What TikPlan is

TikPlan is a content calendar and scheduling tool that helps you plan, draft, and publish video content to TikTok via TikTok's official Content Posting API. TikPlan is not affiliated with, endorsed by, or sponsored by TikTok Inc. or ByteDance Ltd. Your use of TikTok itself is governed by TikTok's own Terms of Service and Community Guidelines — TikPlan doesn't override or exempt you from those.

3. Your account

You're responsible for the security of your account credentials and for all activity under your account. You must provide accurate information when signing up. You must be at least 18 (or the age of majority in your jurisdiction) to use TikPlan.

4. Subscriptions & billing

  • Paid plans are billed in advance on a recurring monthly basis via Stripe.
  • You can cancel anytime — your plan stays active until the end of the current billing period, then reverts to the Free plan.
  • All payments are non-refundable, except where required by applicable law. You can cancel anytime to stop future billing, as described above.
  • We may change our pricing with reasonable advance notice.

5. Acceptable use

You agree not to use TikPlan to:

  • Publish content you don't have the rights to publish
  • Publish illegal content, or content that violates TikTok's Community Guidelines
  • Attempt to circumvent TikTok's rate limits, automation restrictions, or terms of service
  • Use TikPlan to spam, harass, or mislead others
  • Attempt to gain unauthorized access to TikPlan's systems or other users' accounts
  • Resell or white-label TikPlan without our prior written agreement

We may suspend or terminate accounts that violate these terms, or that we reasonably believe put TikPlan's own TikTok Developer API access at risk.

6. Your content

You retain ownership of the videos, captions, and other content you upload to TikPlan. By uploading content, you grant us a limited license to store, process, and transmit it solely to provide the service (e.g. generating a thumbnail, publishing it to TikTok on your instruction). We don't claim ownership of your content and don't use it to train AI models.

7. AI-generated content

TikPlan uses Google's Gemini API to help draft captions, hashtags, and video hooks. AI-generated suggestions may be inaccurate, generic, or require editing — you're responsible for reviewing and editing anything before you publish it.

8. Affiliate program

If you participate in TikPlan's affiliate program, your referral commissions are subject to the terms shown on the affiliate dashboard, including the verification window and minimum payout threshold in effect at the time. We may adjust commission rates or program terms going forward; changes don't apply retroactively to commissions already earned.

9. Disclaimers

TikPlan is provided "as is." We don't guarantee that publishing, scheduling, or analytics will always work exactly as expected — we depend on TikTok's own API, which is outside our control, including its audit/review status, rate limits, and uptime. We're not liable for content that fails to publish, publishes incorrectly, or for any consequences of your content once it's live on TikTok.

10. Limitation of liability

To the maximum extent permitted by law, TikPlan's total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim arose. We're not liable for indirect, incidental, or consequential damages.

11. Termination

You can stop using TikPlan and delete your account at any time. We may suspend or terminate your access for violating these terms, with notice where reasonably possible.

12. Changes to these terms

We may update these terms from time to time. We'll post the updated version here with a new "last updated" date, and notify you directly for material changes.

13. Governing law

These terms are governed by the laws of Malaysia, without regard to conflict of law principles.
